PHILIPPINE NATIONAL BANK ACCOUNT ACCESS PORTAL TERMS AND CONDITIONS

  1. DECLARATION

    The following Terms and Conditions shall govern the Accountholder's use of PNB Account Access Portal ("PNB Portal") to access his/her authorized and/or eligible accounts online and perform banking transactions. PNB Portal will be available to the Accountholder upon enrollment.

    By applying for, accessing, and using PNB Portal, the Accountholder agrees to the following Terms and Conditions in addition to those contained in the Accountholder's existing accounts with PNB.

    The Accountholder, in accessing or using PNB Portal, hereby consents to the collection, use, processing, transfer, sharing, consolidation, management, and disclosure of his/her personal data and other information, to the extent necessary and appropriate, by PNB, its subsidiaries and affiliates, authorized representatives or agents, service providers and/or selected third parties in accordance with Section 13 below. If the Accountholder is providing PNB with any information relating to a third party, including personal data as defined under Applicable Law, by proceeding or continuing herein, the Accountholder represents and warrants to PNB that he/she has obtained all necessary consents and authorizations for the respective purposes and related transactions in accordance with Section 13 herein.

  2. DEFINITION OF TERMS

    For purposes of these Terms and Conditions, the following terms shall have the meanings indicated below:

    1. 2.1 Accountholder - refers to an individual who maintains a deposit account with PNB accessing or using the PNB Portal.
    2. 2.2 Applicable Law - Republic Act (RA) No. 10173, or the Data Privacy Act of 2012, its Implementing Rules and Regulations, other issuances of the National Privacy Commission (NPC), the PNB Data Privacy Statement, and other relevant laws and regulations on confidentiality and data privacy.
    3. 2.3 Bank or PNB - refers to the Philippine National Bank.
    4. 2.4 Banking Day - refers to days (excluding Saturdays, Sundays, and holidays) on which banks are open for business.
    5. 2.5 Credit Cardholder - refers to an individual who maintains a credit card with PNB.
    6. 2.6 One-Time Personal Identification Number (PIN) or OTP - refers to the six (6)-digit numeric code sent to the Accountholder's registered mobile number needed for two-factor authentication.
    7. 2.7 Online Activation Code or OAC - refers to the six (6)-digit alphanumeric code sent to the Accountholder'sregistered e-mail address needed for authentication.
    8. 2.8 PNB Portal - refers to the PNB Account Access Portal banking service which serves as the Accountholder's point of access to select PNB services online.
    9. 2.9 Source Account - refers to a deposit account to be debited for investments in UITF and charges for Checkbook orders.
  3. ACCOUNTS ELIGIBLE FOR ENROLLMENT

    1. 3.1 The Accountholder may use PNB Portal by using/linking his/her active deposit account/s upon creation of his/her online access thru online enrollment.
    2. 3.2 Accountholders enrolled under PNB Portal will be able to use its facilities. The Accountholder has the option to subsequently add his/her other deposit accounts to his/her PNB Portal user account.
    3. 3.3 Eligibility for Deposit Account Enrollment

      Only single-named accounts or "joint or" accounts may be enrolled to PNB Portal. The Bank may, at its discretion, allow enrollment of other types of accounts.

      Automated teller machine (ATM) Cardholders may enroll their ATM accounts in PNB Portal using their card details. It is advised that the Accountholder change his/her ATM PIN at any PNB ATM after successful enrollment to PNB Portal.

      Accountholders may also enroll their non-ATM accounts in PNB Portal by submitting a duly accomplished Electronic Banking Enrollment Form to their branch of account. The branch will process the enrollment and the Accountholder will thereafter receive a temporary PIN through his/her registered mobile phone. Upon receipt of the temporary PIN, the Accountholder should immediately use that PIN to enroll in PNB Portal. The Accountholder must keep his or her PIN secure and not disclose the same to any party.

      To authenticate the enrollment, an OTP will also be sent to the Accountholder's registered mobile number. An OAC will be sent to the Accountholder's registered e-mail address to be used for authentication upon initial log-in.

      For enrollment of "joint or" deposit accounts, the consent of all depositors should be obtained prior to enrollment under PNB Portal. Both the Primary and Secondary Accountholders will be allowed to sign-up by submitting a duly accomplished Electronic Banking Enrollment Form to their branch of account.

  4. SECURITY

    The Accountholder shall assign a Username and Password that will be used when accessing PNB Portal.

    For certain transactions, PNB may issue a system-generated OTP sent as a text message to the Accountholder's mobile phone number registered with PNB Portal. The Username, Password, and OTP, as may be applicable, will be used to validate transactions made through PNB Portal.

    The Username, Password, and OTP shall be for the exclusive use of the Accountholder. The Accountholder must ensure the security of his/her PNB Portal account by observing the following security measures:

    1. Not keeping any written record of the password on, with, or near his/her computer;
    2. Not displaying or allowing another person to see the password during login;
    3. Not using the password negligently or recklessly which will contribute to or cause losses from any unauthorized transaction by any third party;
    4. Avoid using date of birth, identity card number, or mobile number as the password;
    5. Checking the account details and transactions and reporting any discrepancy without undue delay; and
    6. Logging out of PNB Portal properly after use and not leaving his/her computer/gadget unattended.
    7. Avoid using public or somebody else's computer to access PNB Portal

    Under no circumstances shall the Accountholder reveal his/her password to anyone including any of the Bank's personnel. If the password is exposed or suspected to be exposed to another person, the Accountholder shall immediately reset his password in PNB Portal or contact the Customer Care Hotline at +632 8573 8888 to deactivate his/her PNB Portal access.

    The Accountholder's use of his/her User ID, Password and OTP will serve as his/her authorization for the Bank to carry out the transactions initiated under PNB Portal unless said User ID, Password and OTP has been compromised and the Bank has been duly notified thereof by the Accountholder. The Bank shall be entitled to rely on the credentials provided by the Accountholder and any and all transaction/s acted upon by the Bank through the use of Username, Password and OTP shall be conclusively binding on the Accountholder. The Bank shall not be liable for non-receipt or delay in the receipt of the OAC and OTP caused by factors affecting Accountholder's mobile phone or internet service provider.

    It is understood that the Accountholder shall be responsible for the confidentiality of his/her personal information such as, but not limited to, his/her address, mother's maiden name, telephone number, Tax Identification Number, ATM PIN, account number, e-mail address, and other personal identification details, and shall not, under any circumstance, unnecessarily compromise the confidentiality thereof.

    The Bank may collect and retain information such as, but not limited to, the computer name, model and details, operating system version, mobile service provider, country code, browser, Internet Protocol (IP) addresses, Global Positioning System (GPS) location and other relevant security information as a result of using PNB Portal. This set of information will be used by the Bank to provide additional security, upgrade on feature and enhancement of customer experience in PNB Portal.

    The Bank shall implement the proper security measures as well as authentication or verification technologies and services for the Accountholder's secured use of PNB Portal, however, the Bank does not assure that such measures technologies and services will be completely secured, adequate or successful to prevent any unauthorized access, hacking or identity theft. The Accountholder shall still be responsible to ensure that he is connected to a secured network while using PNB Portal.

    The Bank shall not be liable for any loss, damage or liability to the Accountholder and/or any third party arising from or in connection with any fraudulent, unlawful or unauthorized use of PNB Portal resulting from the Accountholder's act, fault or negligence, such as, but not limited to: unauthorized disclosure of mobile phone number, email, password, OAC, PIN or OTP; unauthorized use of security features/credentials.

  5. AVAILABILITY OF PNB ACCOUNT ACCESS PORTAL AND TRANSACTION CUT-OFF

    PNB Digital/Portal shall be available to the Accountholder seven (7) days a week, twenty-four (24) hours a day, except: (i) during system and host maintenance performed from time to time; and (ii) in case of computer, telecommunication, electrical or network failure, or for any other reason beyond the control of the Bank. The Bank reserves the right to schedule and perform system and host maintenance, as the Bank deems necessary, with prior notice to Accountholders via an advisory to be made on PNB's official website pnb.com.ph or Short Message Service (SMS).

    Although PNB Portal may be available, the Accountholder understands that "banking days" shall mean Monday to Friday (excluding Saturday, Sunday and official national or local holidays) when the Bank is open for business. Any financial transaction by the Accountholder through PNB Portal shall be processed and value-dated on the same day, provided, that the transaction is made on a banking day and within the Bank's prescribed cut-off time, which the Bank may change from time to time, as it deems necessary. Transactions made through PNB Portal are subject to the Bank's prescribed cut-off time. Transactions made after the designated cut-off time(s) shall be processed the same day but value-dated the following banking day.

  6. SERVICES AVAILABLE IN PNB ACCOUNT ACCESS PORTAL

    Account Inquiry. The Accountholder may inquire about the account balances of his/her current, savings and time deposit accounts. The Accountholder may also view and download a detailed transaction history of his or her current and savings accounts.

    Add Account. The Accountholder may add his/her other PNB current or savings accounts to the PNB Portal by providing the correct account details. The Accountholder will receive an OTP sent to his/her registered mobile number with PNB.

    For "joint or" deposit accounts, the consent of all depositors should be obtained prior to the adding of an account in PNB Portal. Both the Primary and Secondary Accountholders will be allowed to add an account.

    The account to be added must be linked to the Accountholder's Customer Identification Number with the Bank. The status of the account must be active for it to be successfully added to PNB Portal. Additional restrictions may apply for some accounts as determined from time to time at the Bank's discretion.

    Invest in Unit Investment Trust Fund. The Accountholder can invest in PNB Unit Investment Trust Funds (UITF) through PNB Portal. The PNB UITF are trust products of the PNB Trust Banking Group (the "Trustee"), and not considered as bank deposits, thus, participation therein does not carry any principal protection, has no guaranteed rate of return and is not insured by the Philippine Deposit Insurance Corporation (PDIC). The Accountholder may learn more about UITF by accessing the product web page pnb.com.ph/pnbfunds.

    Credit Card Application. The Accountholder may apply for a PNB Credit Card through the PNB Portal. He/She can likewise check the status of his/her credit card application therein.

    Checkbook Request. The Accountholder may request for a checkbook through the PNB Portal. The checkbook may be picked up at the Accountholder's maintaining branch three (3) weeks after date of request. The Accountholder hereby authorizes PNB to debit his/her Source Account for the cost of checkbook(s) ordered via the PNB Portal. Proof of identity will be required to release the checkbooks. A letter of authorization is required if the checkbook(s) will be picked up by an Accountholder's representative.

    Change Password. The Accountholder may change his/her Password in PNB Portal. For security reasons, the Bank encourages the Accountholder to regularly change his/her Password. The Bank shall automatically block or disable access to the PNB Portal account in case a wrong Username or Password is entered three (3) consecutive times. The Accountholder may contact PNB Customer Care Hotline at +632 8573 8888 for immediate assistance.

    Reset Password. If the Accountholder forgets his/her Password in PNB Portal and his/her access is to PNB Portal gets denied, he/she may nominate a new one by clicking on the Reset Password button in PNB Portal's pre-login screen.

    Other Banking Services. The Accountholder can access other services and features provided by PNB Portal such as Last Login, Transaction History, Transaction Details, About PNB, PNB Products, PNB contact details, Frequently Asked Questions (FAQs), Terms and Conditions, Email and SMS Alerts.

    New services may be introduced by the Bank from time to time and the Accountholder will be duly informed of these new services. By accessing or using these services upon availability, the Accountholder agrees to be bound by the terms and conditions governing such services.

    Availability of Services. PNB reserves the right to amend, vary, restrict, terminate or withdraw the benefits, services, facilities and privileges with respect to the deposit account whether specifically relating to the Accountholder or to all Accountholders.

    The Bank does not guarantee the continuous availability of any PNB Portal features and/or services. The Bank in its sole determination reserves the right to terminate or suspend any PNB Portal feature and/or service subject to prior notice.

  7. CUSTOMER SERVICE

    The Accountholder may communicate with the Bank regarding new products and/or promotions as well as any concerns related to PNB Portal and other Bank services by calling its Customer Care Hotline at +632 8573 8888, sending an email to customercare@pnb.com.ph or calling the branch of account.

    Customer concerns are handled following the Bank's Consumer Assistance Process. The Bank will ask the Customer for information needed to investigate and address the concern and record the same for reference.

    All Customer concerns will be acknowledged immediately. Resolution of concerns would take a minimum of 1 to a maximum of 45 days from the date of receipt of the complaint with complete documentation, depending on the complexity and required depth of investigation.

  8. PERSONALIZATION

    The Accountholder may update his / her personal information. Certain changes in customer information, such as change in e-mail address and mobile number, will require further verification and approval by the maintaining branch. In such cases, the Accountholder needs to proceed to their maintaining branch for these changes to take effect.

  9. SERVICE CHARGES AND OTHER FEES

    Standard fees and charges will apply to services and features that are accessible through PNB Portal as applicable (pnb.com.ph/feesandcharges). PNB also reserves the right to impose new service and maintenance charges and change existing charges within the limits allowed under regulation and upon compliance with requirements thereof. The rate of such new charges, period and method of payment shall be published in PNB's official website.

  10. CANCELLATION

    The Bank reserves the right to cancel, terminate, or suspend the use of PNB Portal granted to the Accountholder for reasons including, but not limited to fraud, improper handling, insufficient account balance or violation of these Terms and Conditions, subject to notice to Accountholder.

    The Accountholder may cancel or terminate his/her access or use of PNB Portal by accomplishing a cancellation form and submitting the same to the branch of account.

  11. CONSENT TO RECEIVE ANNOUNCEMENT

    The Accountholder consents to receive messages, advisories, or announcements from PNB Portal regarding service downtime, featured services, changes in the fees and charges, and marketing promotions via, but not limited to, the Bank's website, e-mail, and SMS.

    The Accountholder understands that in communicating to him/her through e-mail or SMS, the Bank will, in no case, ask from him/her any information about his/her account(s).

    The Accountholder, at any time, may suspend or withdraw the consent to receive announcements by contacting customer service.

  12. INDEMNITY CLAUSE

    The Bank, including its directors, stockholders, officers, and/or representatives, will not be liable for any losses or damages howsoever arising whether in contract or any other basis, including without limitation, actual, consequential, temperate, or nominal damages resulting from circumstances over which it has no direct control including, but not limited to, the failure of electronic or mechanical equipment or communication lines or other interconnection problems, severe inclement weather, earthquakes, floods, or other damages, or loss of profits or savings arising in connection with the access or use or the inability to access or use PNB Portal, or reliance on the information contained herein, or for any technical, hardware or software failure of any kind, or the interruption, error, defect, omission, delay in operation or transmission, computer viruses or line or system failure, even if PNB is advised of the possibility of such damages, loss or expenses.

  13. DATA PRIVACY

    The Accountholder authorizes the Bank, its subsidiaries and affiliates, to the extent allowed by the Applicable Law, to collect, obtain, use, process, verify, transfer, store, consolidate, disclose, or share the Accountholder's Personal Information (as defined under the Applicable Law) such as name, date of birth, gender, contact details, and other information such as identity supporting documents, bank account, account information or records, credit standing, business transactions, and business and credit relationships, for any or all of the following purpose/s:

    1. a) To validate the identity of the Accountholder and perform customer due diligence;
    2. b) To manage and monitor the Accountholder's account;
    3. c) To evaluate, approve, implement, and administer any and all products being availed of by the Accountholder;
    4. d) To comply with the Bank's operational requirements which includes, without limitation, business continuity planning, risk management, safety and security, system enhancement, product development and research, audit, warehousing and retrieval of data;
    5. e) To meet PNB's legal and regulatory obligations arising from foreign or domestic law or regulation on money laundering, terrorist financing, fraud, exchange of information, and other applicable laws.
    6. f) To request, disclose, submit, share or exchange the Accountholder's credit history or account information to government regulatory authorities, credit bureaus, financial institutions, merchant partners and third-party content providers;
    7. g) To improve and develop the products, services and facilities of PNB, its subsidiaries and affiliates, and to conduct product research and development, business analysis, benchmarking, and market studies; and
    8. h) To enable PNB to assign or transfer, wholly or partially, any of its rights, obligations, and liabilities and causes of actions, tangible or intangible, to a third party.

    The Accountholder shall indemnify and hold the Bank, its directors, officers, employees, authorized representatives, its subsidiaries and affiliates and third party service providers, as well as the directors, officers, employees of its authorized representatives, subsidiaries and affiliates, and third party service providers, free and harmless from any claim, damage or liability of whatever kind and nature that may arise in connection with the collection, storage, use, processing, verification, gathering, transfer, consolidation, disclosure, or sharing of any information provided relative to the foregoing purposes. This authorization and consent shall be valid and effective until the expiration of the retention limit set by laws and regulations.

    Furthermore, in relation to any personal information and sensitive personal information ("Personal Data") as defined under the Applicable Law, the Accountholder is aware that the person to whom the Personal Data pertains ("Data Subject") has the right to be informed of, and object to, the processing of his/her Personal Data, to access and to rectify any error or inaccuracy thereto. The Data Subject also has the right to suspend, withdraw, or order the blocking, removal or destruction of Personal Data that is incomplete, false, unlawfully obtained, processed or used for unauthorized purpose, or prejudicial to the Data Subject, and to be indemnified for damages sustained due to inaccurate, incomplete, outdated, false, unlawfully obtained or unauthorized use of such Personal Data. If the Accountholder shall provide the Bank Personal Data as required by, pursuant to, or in connection with the foregoing purposes, the Accountholder represents and warrants to the Bank that the Accountholder has, to the extent required by the Applicable Law: (i) notified the Data Subject of the purposes for which the Personal Data will be collected, processed, used or disclosed, and (ii) obtained the Data Subject's consent for, and hereby consents on behalf of such Data Subject, to the collection, processing, use and disclosure of his/her Personal Data by the Bank in accordance with the foregoing purposes. The Accountholder confirms that such Data Subject has authorized the Accountholder to provide such consent on his/her behalf. The Accountholder further agrees and undertakes to notify the Bank promptly upon becoming aware of the withdrawal by the relevant consent to the collection, processing, use and/or disclosure by the Bank of any Personal Data provided in connection herewith.

    For further information, the Accountholder may access the Bank's Data Privacy Statement at www.pnb.com.ph or email the Bank's Data Protection Officer at pnbdpo@pnb.com.ph. Also, the Accountholder hereby acknowledges that he/she has read and understood PNB's Data Privacy Statement on its website.

  14. OTHER AGREEMENTS

    In case of "joint or" accounts, each and every Accountholder shall be jointly and severally responsible for all transactions involving the use of PNB Portal and the terms and conditions herein shall be jointly and severally binding on each and every one of the Accountholders.

    The Accountholder shall be responsible for all transactions made through PNB Portal using his/her ATM Card number, ATM PIN, Account Number, OTP or his/her Username and Password absent any manifest error.

    The Accountholder agrees that the use of PNB Portal have risks on security, reliability, availability, data corruption, transmission error and the like. The Accountholder hereby accepts, to the maximum extent provided by law, full responsibility for ensuring the correctness of all transaction information given. The Bank shall only rely on such information provided by the Accountholder, and as such, the Accountholder holds the Bank free and harmless from any damages resulting from the Bank's reliance on the information given.

    The Accountholder understands that it is his/her responsibility to provide and maintain an operational and available e-mail address and/or mobile number for the Bank to send communications or notifications as may be necessary. The Accountholder agrees that all particulars, data, information and documents provided or submitted to the Bank are complete, accurate and true to the best of his/her knowledge, and he/she shall immediately notify the Bank in writing of any changes thereto.

    The Bank is not responsible for any bounced or delayed emails sent to the Accountholder due to, but not limited to, the following reasons: mailbox unavailable, mailbox full or quote exceeded, host unknown, blacklist filters and content filters.

    The Bank will not be obliged to complete financial transactions that are not covered by sufficient funds. Only cleared and withdrawable balances of the enrolled accounts shall be considered for these transactions. In case of insufficient funds, the request will be cancelled automatically, without need of prior notice. The Bank shall have no obligation or liability if it does not complete a transaction due to insufficiency of funds in the enrolled account of the Accountholder.

    The Bank does not warrant or represent that access to the whole or part of PNB Portal, or information and/or functions herein will, at all times, be provided uninterrupted or free from errors or free from unauthorized third party interception or that any identified defect will be corrected, or that there will be no delays, failures, errors, omissions, or loss of transmitted information, or that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to the device of the Accountholder. The Accountholder understands that account information, details, and/or services may not be available during end of day batch processing and/or system maintenance.

    The Bank is the owner of PNB Portal, thus, the Accountholder shall use PNB Portal only for the intended purpose agreed upon by the parties hereto and shall not disassemble, decompile, copy, modify or reverse-engineer the software or participate/cooperate with anyone else in doing any of the foregoing.

    The failure of the Bank to exercise or enforce any right or remedy under these Terms and Conditions shall not constitute a waiver of such right or remedy.

    PNB hereby reserves the right to modify, amend and revise these Terms and Conditions as may be applicable to accommodate new or existing features or services of PNB Portal, which will take effect immediately after notice or publication. The Accountholder's continued access and use of PNB Portal will constitute his/her acceptance of the modification/s, amendment/s or revision/s of these Terms and Conditions. All terms and conditions of the Accountholder's existing deposit account/s with PNB shall remain in full force and effect.

    In case of conflict between these PNB Portal Terms and Conditions and the terms and conditions governing the relevant transactions, products, or services, the latter will prevail. All terms and conditions of the Accountholder's existing deposit account with PNB shall remain in full force and effect.

    If any part of these Terms and Conditions is determined to be unconstitutional, invalid or unenforceable pursuant to any applicable law by a court of competent jurisdiction, the other provisions of the Terms and Conditions not so declared to be unconstitutional, invalid or unenforceable shall continue to be in full force and effect.

    If, by the Accountholder's act or omission, fault or negligence, the Bank becomes involved in any litigation which may have relation with PNB Portal, the Terms and Conditions of its use, or with any rights, powers and remedies hereunder, then the Accountholder agrees to pay all fees and expenses incurred by the Bank in such litigation.

    Notwithstanding the foregoing, the Bank may be held liable for actual loss or damage suffered by the Accountholder due to the Bank's gross negligence, misfeasance, or bad faith in the performance of its obligations hereunder.

    Any legal action arising under or by virtue of these Terms and Conditions shall be brought exclusively in the proper courts of Pasay City and by accessing or using PNB Portal, the Accountholder irrevocably submits to the jurisdiction of such courts.

  15. CUSTOMER ASSISTANCE

    The Accountholder may report any concern on the use of PNB Portal through the following channels:

    1. Approach our Customer Assistance Officer (CAO) or the Sales and Service Head (SSH) in the branch of account.
    2. Call the Bank's 24/7 Customer Care Hotline at +632 8573 8888 or email customercare@pnb.com.ph.
